Article 1 - APPLICATION OF CONDITIONS

The company is registered with the "autoentrepreneur" french law (created on 2009/01/01) and the purchaser is defined below as being the company or the person who signs and accepts the present Terms and Conditions.
The purchaser admits to have the ability to contract on the described conditions below, has the legal majority and is not under tutelage. The purchaser has read the Terms and Conditions, and has accepted them, before placing order.
These Terms and Conditions are linked to all sales concluded by HEART JACKING.All other conditions responsabilize the seller only after written confirmation of his/her part.The only fact to place an order or to accept an offer of the seller leads to acceptance of these terms and conditions.Any condition not written in our general terms that the purchaser would have formulated will be rejected unless we admit it in a written way.
The present terms and conditions can change at any time and without notice by HEART JACKING, in this way modifications will be applicable to any posterior orders.
Article 2 - ORDERS
Orders can be considered as real from the date of receipt of the payment.
Any offer of sale is subject to the stock.Nevertheless, if in spite of the alertness of the seller concerning its supplies, products would be unavailable, the HEART JACKING company will give you a credit, or send your order when the products will be received by us. The choice will be taken by the company Heart Jacking firstly, by the purchaser secondly.
The Heart Jacking company promises to deliver the purchaser as soon as possible, no specific delay being declared.
Any clause, emanating from the purchaser and not accepted in a writing way by the seller, and which would be in opposition to the present terms and Conditions will be considered as useless. No unilateral cancellation of order will be accepted without the agreement of the HEART JACKING company.
Article 3 - PRICES
The list of prices does not constitute a sale. It can be unilaterally changed without prior information before the purchase by the client.The goods are invoiced to the admitted price within the limits of delay of option and of general economic conditions (taxes, exchange rate...), at the time of delivery.
All prices pointed out on the website of the seller are nets and in euros, all taxes included, except transport charges, which will be showed and noticed before the order recording by the purchaser.
In case of difference between the price pointed out on the web site and the current price, because of an error of writings, of calculation or other bad manipulations, the price pointed out on the web site of the seller will be the applicable.The purchaser will nevertheless be able to cancel or change his order in case the rate in force would be higher than the rate pointed out on the Internet site of the seller.
Article 4 - PAYMENT
The payment of the totality of price must be accomplished during the order by the purchaser.
To regulate his/her order, the purchaser has several possible means of payment :Paypal (and therefore credit card), cheque, bank transfer, mandate, Western Union.
The purchaser guarantees to the HEART JACKING company that he/she has the eventual abilities and permissions to use the method of payment that he has chosen, during the recording of the order form.
The HEART JACKING company has the right to suspend or to cancel any order and/or delivery, whatever their nature and level of execution, in case of non-payment of any sum owed by the purchaser or in case of incident of payment.
The HEART JACKING company has the right to ask for a photocopy of any identity document, for any order.
In relation with the struggle against frauds on Internet, the information linked to your order may be controlled for verification.
Article 5 - CHOICE OF ARTICLES
The purchaser having learnt about products and their features sold by the HEART JACKING company, has under his/her only responsibility the choice of his/her buyings.
Any picture of this website is likely to be not contractual, without the need of particular notation except this one.
The HEART JACKING company has the right, in case of stock shortage of an article, to send the most similar article which can be supplied.
Articles 6 - DELIVERY
- GENERAL RULES :
Products will be delivered at the address pointed out by the purchaser on the order form.
So as to send to the purchaser the ordered products, the HEART JACKING company works first and foremost with La Poste and uses Colissimo, Lettre Suivie, Lettre Max, Distingo, Postexport and other La Poste products.
- PROBLEMS OF DELIVERY:
The purchaser is required to prove, in the presence of La Poste, the state of the package.In case of any doubt by the purchaser, he/she has to:
- apply La Poste procedure (to signal damages, claims and reservations) and to refuse the goods by creating immediately an official report of anomaly (official report 170).
- signal these incidents to contact@heartjacking.com within 7 days as from the refusal of the goods by the Purchaser.
If there is a lack in the respect of this procedure, no claim of the purchaser will be accepted.
- PROBLEMS OF QUALITY
In case of the delivery of a product not corresponding to your order, the purchaser must formulate his/her claim within 7 days from the moment he/ she received the package.
Claims must be addressed by mail at contact@heartjacking.com, and have to include:
- the name, first name, adressee of the Purchaser
- the order number
- the encountered problems
A mail will be sent to you, with the appropriated procedure.
Not satisfacting products will have to be resent within 7 days after the first receipt.
If the procedure is not respected, HEART JACKING company will not make an exchange, nor a credit.
Every product to be exchanged or to credit will be resent to its state and packing of origin and include the whole product and its accessories in a perfect state of resale.

- DELAYS:
La Poste packages allow a delivery for a medium delay of 48 h for France, 96 h for the rest of Europe and for french DOM TOM, 5 days for the rest of the world.This delay is given as information only and any possible more delays will not give some benefits to the purchaser.
The order will be sent only after that the payment totally received.
In case of delay of delivery in comparison with initially fixed date, the purchaser will be able to signal it by mail (Contact@heartjacking.com) to the HEART JACKING company, so as to improve the service quality and to allow to the seller to search the package and notify La Poste.
Articles 7 - RETURN OF the GOODS
For any return of the goods for a reason other than the notified in the article 6 (Error of the seller or defect of the article), you must contact us within 7 days from the moment you received the package, telling us the number of order, the articles that you want to return us and the reason why.
The HEART JACKING company does his best to satisfy you by your order (big size pictures, Windows Live Messenger Hot Line...).
If in spite of taken precautions, an article was not suitable for you, you will have to pay shipping return costs.In reception of the article or of the articles, a credit will be addressed to you by mail.Alone the price of the articles will be credited to you.
Article 8 - PROPERTY
In accordance with law, the transfer of property of the goods delivered to the purchaser will happen only after full payment of the price.
During the period from the delivery to the transfer of property, risks of loss, flight or destruction are supported by the purchaser.The non-respect by the purchaser of his/her obligations of payment confers the right for the seller to demand the immediate restitution of the delivered goods.
Article 9 - applicable Law and clause of jurisdiction:
The present terms and Conditions are subjected to French law. In case of problems, the court of Grenoble (38) will be alone competent.
Article 10 : Computer and Web Freedom.
In accordance with Computer law and Freedom of January 6th, 1978, you have a right of access and of correction of your personal data. Any information can be used by Heart Jacking for advertising purposes.
